Professional Biographies for the California DUI and California DMV Hearing Lawyers of Kapsack & Bair, LLP

Oakland, California DUI lawyer Bruce Kapsack is one of the first attorneys in Northern California to be Board Certified by the National College for DUI Defense as approved as a specialty by the American Bar Association.

Bruce Kapsack graduated from Plymouth State College, cum laude, with a Bachelor of Science degree in English-History-Political Science. While attending law school at the American University, Attorney Kapsack was chosen to argue an Education for all Handicapped Children case before the United States Court of Appeals, Fourth Circuit. He received his Juris Doctorate in 1987, and was immediately hired by the New York Legal Aid Society as a public defender.

During his five years as a public defender, Bruce Kapsack was regularly assigned training of new attorneys, selected for special training in DNA, homicide investigation, and other high profile cases. Due to his trial record, skills, and case management, Bruce Kapsack rose quickly to the Senior Trial Attorney position. He left that office in 1992 to move to California.

Upon admission to the California State Bar, Attorney Kapsack commenced his own practice, specializing in criminal defense. However, his love of dogs led him into the field of dog-bite litigation, where he again showed his pioneering spirit by successfully litigating punitive damages in such cases. Attorney Kapsack ended this practice when he was hired by the San Francisco Police Department as the attorney for the Office of Citizen Complaints.

During his tenure at the OCC (the San Francisco version of internal affairs), Attorney Kapsack distinguished himself by being the first, and only, civilian police misconduct prosecutor to successfully pursue a case leading to officer termination. At the same time, he developed a mediation program, which has been used as a model in other states, regarding police/civilian misconduct. All of this work resulted in Attorney Kapsack receiving a Commendation from the San Francisco Board of Supervisors.

In 1996, Attorney Kapsack was hired as the senior attorney for a large criminal defense law firm specializing in Driving under the Influence defense. Attorney Kapsack quickly gained respect as a passionate DUI litigator and innovator. He was immediately accepted as a Founding Member of the National College for DUI Defense, and was recognized as a specialist by the California Deuce Defenders.

Attorney Bruce Kapsack decided to leave that organization and open his own firm. He has since represented hundreds of clients in court and at the DMV, earning the respect of the prosecutors and judges before whom he regularly appears. In fact, prosecutors have often argued to the jury that Attorney Kapsack is one of the best in his field-a sentiment echoed by more than one judge. During a recent appeal, the prosecution even pointed this fact out in their brief, stating that Attorney Kapsack is a recognized DUI expert.

Attorney Bruce Kapsack is dedicated to representing his clients in an aggressive fashion and pushing the envelope of DUI defense. His recent work on Field Sobriety Tests is regularly used by other attorneys throughout the United States in their defense of DUI clients. Attorney Kapsack also regularly lectures attorneys in the police misconduct and DUI arenas.

Oakland, California DUI lawyer Hudson T. Bair, a California native, went to law school at Golden Gate School of Law located in San Francisco, California. He graduated in 1994 and was admitted to the California Bar in December of that same year. Following graduation, he worked on behalf of individuals injured by work-related contact with asbestos. While representing these individuals he became acutely aware of medical issues relating to lungs, specifically impaired lung function due to asbestos and other occupational causes. That interest led him to the area of breath testing, specifically breath testing for the presence of alcohol. In 1997, he joined with Attorney Bruce Kapsack to form one of the top defense firms in California, focusing exclusively on defense of driving under the influence charges.

Hudson T. Bair has continued to focus on driving under the influence cases. As a member of the Association of California Deuce Defenders and the National College of DUI Defense, he frequently attends training sessions presented by these organizations.

To further his skills and training, Hudson T. Bair has also achieved certification as a Drug Recognition Screener. This very specialized training significantly elevates the chances for success in cases where alcohol is not the suspected cause of the driver's impairment.

In June of 2000, Attorney Bair received certification as an Instructor in Standardized Field Sobriety testing (SFST) by completing a rigorous, forty-hour training session that included both classroom and practical training in the proper administration and use of SFST's.

Attorney Bair knows that his continued emphasis on education in the area of DUI defense strengthens his skills at negotiation and trial. Knowledge of the latest issues with regard to breath and blood testing, friendships with many of the top state and national defense attorneys and hard work are the best tools for a successful outcome to your case.
